Terms and conditions of sale
Last updated: 5 November 2026
This English translation is provided for information only: only the French version of these General Terms and Conditions of Sale is legally binding.
These General Terms and Conditions of Sale (T&Cs) govern purchases made on the website www.cavedechaz.com.
They set out the conditions for ordering, payment, delivery and return of the products sold by Cave de Chaz.
Article 1: Seller identification
The website www.cavedechaz.com is operated by:
CAVE DE CHAZ
A single-shareholder simplified joint-stock company (SASU) with share capital of €10,000.
- Registered office: 24 ter avenue Gabriel Péri, 30400 Villeneuve-lès-Avignon, France
- SIRET: 912 874 005 00016
- RCS: Nîmes, number 912 874 005
- President: Robin Chazalon
- Email: robin@cavedechaz.com
- Telephone: +33 6 27 34 58 72
- Website: www.cavedechaz.com
Hereinafter referred to as “Cave de Chaz” or “the Seller”.
Article 2: Scope
These T&Cs apply to orders placed on the website www.cavedechaz.com by private or business customers.
Any order implies acceptance of these T&Cs, given by ticking a box before the purchase is confirmed.
The applicable T&Cs are those in force on the date the order is confirmed.
Cave de Chaz reserves the right to amend them at any time. Such amendments do not apply retroactively to orders already concluded.
Provisions specific to consumers apply to business customers only where the law so provides.
Article 3: Products and availability
Cave de Chaz offers a selection of wines, champagnes, spirits and related products.
Each product has a description setting out its main characteristics, in particular its estate, cuvée, appellation, vintage and format, where relevant.
Photographs are for illustration purposes only. Minor differences in presentation may exist, in particular regarding labels, capsules or packaging, without altering the essential characteristics of the product ordered.
Product availability
Offers are valid while stocks last.
As some wines are produced in very limited quantities, a product may exceptionally be unavailable despite regular stock updates.
In that case, Cave de Chaz will inform the customer as soon as possible and offer, at the customer’s choice:
- A refund for the unavailable product;
- A replacement product, subject to the customer’s agreement;
- A credit note, only if the customer accepts it.
No replacement product will be shipped without the customer’s agreement.
Article 4: Old, rare and collectors’ wines
Some wines offered by Cave de Chaz come from old vintages, limited productions or private collections.
These bottles may show particular features related to their age or storage:
- A variation in fill level;
- Natural wear of the label or capsule;
- Changes in colour, aromas or sediment;
- Differences in development between bottles of the same vintage.
Where significant particularities are known, they are stated in the product description or communicated to the customer before the sale.
Buying an old wine means taking its natural development into account. The tasting qualities of a wine may vary according to its vintage, storage history and tasting conditions.
Cave de Chaz takes particular care in selecting the bottles it offers, but cannot guarantee the exact taste profile of an old wine.
These provisions in no way limit the legal guarantees applicable to the products sold.
Article 5: Prices
Prices shown on the website are in euros, all taxes included, unless otherwise stated.
Delivery charges are calculated separately and communicated to the customer before the order is finally confirmed.
The total amount payable is summarised before payment.
Cave de Chaz may change its prices at any time. Products are invoiced at the price applicable when the order is confirmed, subject to the legal provisions on obvious errors.
International orders
For deliveries outside France, tax treatment depends on the destination country and the applicable regulations.
For shipments outside the European Union, customs duties, import taxes, excise duties or customs clearance fees may be charged by the authorities or carriers of the destination country.
Unless expressly stated otherwise when ordering, these charges are not included in the price invoiced by Cave de Chaz and are payable by the recipient.
Customers are advised to check the import rules applicable in their country before ordering.
Article 6: Orders
To place an order, the customer selects the desired products and adds them to the basket.
Before payment, the customer can check and change:
- The products and quantities ordered;
- Their contact details;
- Their delivery address;
- The delivery method;
- The total amount of the order.
The order is finally confirmed after acceptance of the T&Cs and confirmation of payment, according to the method chosen.
A summary email is sent to the customer at the address provided when ordering.
The customer undertakes to provide accurate and complete information.
Cave de Chaz reserves the right to refuse or cancel an order for a legitimate reason, in particular in the event of suspected fraud, unauthorised payment or a legal restriction preventing the sale or delivery.
If the Seller cancels an order that has already been paid, the corresponding sums are refunded.
Article 7: Payment
Orders may be paid for using the payment methods offered on the website, including:
- Bank card, via a secure payment solution;
- Bank transfer;
- PayPal, where this option is available.
Payment is due when ordering, including for products offered for pre-order, unless special conditions are expressly stated.
For payments by bank transfer, the order is prepared once the funds have actually been received, subject to the stated availability conditions.
Card transactions are secured by the payment provider used by Cave de Chaz.
Cave de Chaz does not store the full bank details of the cards used by its customers.
If payment is refused or the transaction is not completed, the order cannot be fulfilled.
Article 8: Retention of title
Products remain the property of Cave de Chaz until their price has been paid in full.
This retention of title does not alter the legal rules on the transfer of risk during transport.
Article 9: Delivery
Delivery areas
Cave de Chaz delivers in France and to certain other countries, subject to the regulations applicable to the shipment of alcoholic beverages.
The available destinations, carriers, rates and delivery terms are set out on the “Delivery” page of the website.
Delivery charges
Shipping costs are calculated according to, in particular, the destination, the number of bottles, the weight and the packaging.
The amount is communicated before the order is finally confirmed.
Delivery times
Delivery times or dates are shown to the customer before the order is confirmed.
Cave de Chaz undertakes to meet the stated delivery times, subject to the legal provisions applicable in the event of impediment or delay.
If no delivery time has been agreed, delivery takes place no later than 30 days after the contract is concluded.
Shipments are generally sent from Monday to Friday, excluding public holidays. To limit the time wines spend in transport networks, Cave de Chaz may avoid dispatching on Saturdays and on the day before public holidays.
Weather conditions
As wine is sensitive to extreme temperatures, Cave de Chaz may offer to postpone shipment in the event of a heatwave, frost or weather conditions likely to affect the quality of the bottles.
The customer is informed as soon as possible.
Any postponement is arranged within the agreed delivery time or is subject to a new agreement with the customer, without prejudice to their legal rights.
Article 10: Receipt of parcels and transport damage
Cave de Chaz takes particular care in preparing and protecting the bottles it ships.
On receipt, the customer is advised to check the outside of the parcel.
If the parcel is visibly damaged, the customer is invited to:
- Report the damage to the delivery driver and, if necessary, refuse the parcel, stating “Refused due to damage”;
- Take photographs of the parcel and of the damage observed;
- Contact Cave de Chaz as soon as possible.
In the event of breakage, leakage, a missing bottle or a non-conforming product, the customer may contact Cave de Chaz so that a suitable solution can be found.
These recommendations make it easier to handle claims with carriers, but are not a condition for the legal guarantees to apply.
For sales to consumers, Cave de Chaz remains liable for the risk of loss of or damage to the products until they are physically handed over to the customer or to a third party designated by the customer, except where the law provides otherwise when the customer chooses a carrier not offered by Cave de Chaz.
Article 11: Delays, losses and delivery incidents
In the event of a delay, loss or delivery incident, the customer is invited to contact Cave de Chaz.
Cave de Chaz will take the necessary steps with the carrier and keep the customer informed of the progress of the case.
In the event of late delivery, consumer customers have the rights provided for by the French Consumer Code, in particular the right to request delivery within a reasonable additional period and then, where the legal conditions are met, to terminate the contract.
Where the contract is validly terminated for non-delivery, Cave de Chaz refunds the sums due within the legal time limit.
Article 12: Right of withdrawal
In accordance with Article L.221-18 of the French Consumer Code, consumer customers have 14 calendar days from receipt of the products to exercise their right of withdrawal, without having to give reasons for their decision.
Where several products from the same order are delivered separately, the period runs from receipt of the last product.
To exercise this right, the customer must inform Cave de Chaz of their decision by an unambiguous statement sent by email or by post.
They may also use the model withdrawal form in the appendix to these T&Cs.
Return of products
The customer has a further 14 days from the communication of their withdrawal decision to return the products.
The direct costs of return are borne by the customer, unless otherwise provided or expressly agreed by Cave de Chaz.
Bottles must be protected in suitable packaging to limit the risk of breakage.
The customer may be held liable for any loss in value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the products.
Refund
Cave de Chaz refunds the sums due, including the initial standard delivery charges, within a maximum of 14 days of notification of the withdrawal.
The refund may be withheld until the products have been recovered or proof of their dispatch has been received, whichever is earlier.
Additional costs resulting from the choice of a more expensive delivery method than the standard method offered are not refunded.
The refund is made using the same means of payment as for the purchase, unless the customer expressly agrees to another means at no additional cost.
Legal exceptions
The right of withdrawal does not apply in the cases expressly provided for by Article L.221-28 of the French Consumer Code, in particular for certain clearly personalised products.
A bottle of wine is not automatically excluded from the right of withdrawal simply because of its rarity, vintage or value.
Article 13: Legal guarantees and conformity
Products sold to consumers benefit from the legal guarantees provided for by French law.
Legal guarantee of conformity
In accordance with Articles L.217-3 et seq. of the French Consumer Code, consumers benefit from the legal guarantee of conformity under the conditions and within the time limits provided for by law.
In the event of a lack of conformity, they may request that the product be brought into conformity and, where the legal conditions are met, obtain a price reduction or termination of the sale.
The costs of implementing this guarantee are borne by the Seller in accordance with the regulations.
Guarantee against hidden defects
The customer also benefits from the guarantee provided for by Articles 1641 et seq. of the French Civil Code.
Where the legal conditions are met, they may request cancellation of the sale or a price reduction.
Claims
For any request concerning a broken bottle, the wrong cuvée, vintage or format, or any other defect observed, the customer may contact Cave de Chaz, stating their order number and the nature of the problem.
Photographs may be requested where they are useful for examining the claim.
Nothing in these T&Cs limits the consumer’s legal rights.
Article 14: International orders and customs formalities
Orders shipped abroad are subject to the regulations applicable in the destination country.
In particular, the customer must ensure that the import of alcoholic beverages is permitted in the country concerned.
Depending on the destination, specific formalities may be required.
Any taxes, customs duties, excise duties and customs clearance fees due are specified according to the conditions applicable to the shipment.
Unless otherwise stated, import charges not included in the sale price are payable by the recipient.
If the recipient refuses to pay import charges or fails to complete the formalities for which they are responsible, Cave de Chaz will seek a solution with the customer.
Any additional costs attributable to the customer may be invoiced or deducted from a refund only within the limits permitted by the applicable regulations and provided they are justified.
Nothing in this article deprives consumers of their legal rights.
Article 15: Gift boxes, subscriptions and special offers
Cave de Chaz may offer wine gift boxes, personalised offers and subscriptions giving access to a regular selection of bottles.
The characteristics of each offer, its price, its contents or selection method, its frequency, its delivery charges and its special conditions are presented before subscription.
For automatically renewed subscriptions, the customer is informed of the payment, renewal and cancellation terms.
Unless more favourable special conditions apply, a cancellation request may be sent by email at least one month before the next scheduled box.
Where required by the regulations, Cave de Chaz also provides an online cancellation feature that is free of charge and easily accessible.
The provisions on the right of withdrawal and the legal guarantees remain applicable under the conditions provided for by law.
Article 16: Sale of alcohol and protection of minors
In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcoholic beverages to minors is prohibited.
By placing an order on the website, the customer declares that they are at least 18 years old and have the legal capacity required to purchase the products offered.
Cave de Chaz may request proof of age under the conditions provided for by the regulations.
For international deliveries, the customer must also comply with the legal age for buying and receiving alcohol in the destination country.
Alcohol abuse is dangerous for your health. Please drink responsibly.
Article 17: Personal data
Cave de Chaz collects and processes certain personal data necessary for managing orders, payments, deliveries and customer relations.
This processing is carried out in accordance with the General Data Protection Regulation (GDPR) and applicable French law.
Under the conditions provided for by the regulations, the customer has in particular the rights of access, rectification, erasure, objection and restriction of processing of their data.
Marketing communications
Cave de Chaz may send information and commercial offers to people who have given their consent or in the other cases permitted by the regulations, in particular for products similar to those already purchased by its customers, subject to the legal conditions.
Each marketing communication includes a simple way to unsubscribe.
Article 18: Intellectual property
All content on the website www.cavedechaz.com, in particular texts, photographs, graphic elements, logos and editorial content, is protected by the applicable intellectual property rights.
Any unauthorised reproduction, distribution, modification or use of this content is prohibited, except as provided for by law.
Article 19: Force majeure
Cave de Chaz cannot be held liable for failure to perform its obligations resulting from an event meeting the legal conditions of force majeure.
If such an event occurs, Cave de Chaz will inform the customer as soon as possible.
Where the impediment is temporary, performance of the contract may be suspended under the conditions provided for by law.
If the impediment becomes permanent, the consequences for the contract and any refunds will be determined in accordance with the applicable legal provisions.
Article 20: Claims and mediation
For any question or claim concerning an order, the customer may contact Cave de Chaz:
- By email: robin@cavedechaz.com
- By post: Cave de Chaz, 24 ter avenue Gabriel Péri, 30400 Villeneuve-lès-Avignon, France
- By telephone: +33 6 27 34 58 72
Cave de Chaz favours the amicable resolution of any disputes.
In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumers may use a consumer mediator free of charge with a view to the amicable resolution of a dispute, after first sending a written complaint to the Seller.
Article 21: Governing law and disputes
These T&Cs are governed by French law.
For consumers residing in another country, this provision does not deprive the customer of the mandatory protections they enjoy under the law applicable to their situation.
In the event of a dispute, the parties will first seek an amicable solution.
Failing that, the dispute may be brought before the competent courts in accordance with the applicable legal rules.
Article 22: Final provisions
If any provision of these T&Cs is declared null or unenforceable, the other provisions will remain valid.
These T&Cs are available at any time on the website www.cavedechaz.com.
